Documents prepared prior to signing

  • Identification and representation: original valid identity documents, NIE numbers, and powers of attorney (with apostille and sworn translation if granted abroad).
  • Property status: updated land registry extract (nota simple), property tax (IBI) receipts, certificate of zero debt from the community of owners, certificate of occupancy, and energy efficiency certificate.
  • Financial records: means of payment (bank draft copies, certified transfers), mortgage documentation or mortgage cancellation certificates.
  • Tax records: checking fiscal values, capital gains tax declarations, and non-resident withholding certificates (Form 211).

Reviewing the deed draft

The notary provides a draft of the deed (minuta) days prior to the signing date. We review every single clause: purchase price, payment methods, inventory of included fixtures, fiscal declarations, and distribution of statutory costs between buyer and seller.

Resolving discrepancies in advance

Detecting an error at the signing table causes delays, stress, and potential extra costs. We resolve any discrepancy directly with the notary officer, the counterparty's legal counsel, and banking representatives before you enter the notary office.

Post-signing formalities

Preparation also includes coordinating next steps: tax settlement within the strict 30-business-day window and submission of the certified deed to the competent Land Registry.
